Terms of Use (ToU) – RUNSWAP

1. Purpose

These Terms of Use (hereinafter "ToU") are intended to define the terms and conditions of use of the RunSwap platform (hereinafter "the Platform"), enabling connections between runners wishing to resell or purchase a bib for a sporting event, in a secure framework.

RunSwap is neither an event organizer nor a registration provider.

RunSwap operates exclusively as a technical intermediary, providing a secure service for connecting users, document verification, and user assistance.

2. Definitions

Seller: initial holder of a valid bib, wishing to transfer it.

Buyer: runner wishing to purchase a bib for sale.

Organizer: entity in charge of the event (association, company, local authority).

Transaction: the entire process including listing, purchase, payment, document transmission, and payment to the seller.

Pickup proof: all documents enabling bib pickup from the organizer (pickup voucher, ID card, confirmation, QR code, etc.).

3. RunSwap's role and limitations

RunSwap:

  • connects sellers and buyers
  • secures payments
  • verifies the consistency of documents provided
  • holds funds until race pickup (buyer protection)
  • provides assistance in case of disputes

RunSwap cannot in any case:

  • guarantee that the organizer accepts name changes
  • intervene in an event's internal rules
  • guarantee access or participation in an event
  • be held responsible in case of pickup refusal, access denial to the starting corral, or cancellation by the organizer
  • be held responsible for fraudulent pickup, dangerous behavior, or harassment between users

Rules relating to race participation are exclusively determined by the organizer.

The user acknowledges using the platform with full knowledge of these limitations.

4. Price, payment and RunSwap fees

The seller sets the sale price within a limit of ±10% of the initial price (to avoid speculation and abusive resale).

RunSwap charges fixed operating fees of 10% of the listed price.

Funds are:

  • paid to the seller only when all documents are complete
  • released 72 hours after the race, except in case of a declared dispute (buyer security)

In case of race cancellation, date change, or non-acceptance of the bib by the organizer, RunSwap is in no way responsible.

5. Resale process

The seller commits to:

  • Hold a valid, paid, non-cancelled, unused bib
  • Transmit all required documents within a maximum period of 72 hours
  • Not pick up or use the bib after sale
  • Not resell the same bib simultaneously on multiple platforms
  • Not provide falsified documents

Any violation results in permanent account deletion and possible transmission to authorities (document fraud, fraud).

6. Purchase process

The buyer acknowledges:

  • having consulted and accepted the ToU before purchase
  • that RunSwap does not guarantee acceptance of a name change
  • that the organizer may refuse pickup in a third party's name
  • that they may pick up the bib in the seller's name if the organizer allows it
  • that RunSwap provides a personalized post-race certificate upon simple request

The buyer cannot demand a refund:

  • in case of non-acceptance of the name change
  • in case of access denial to the starting corral by the organizer
  • if they have already received the documents enabling pickup

7. Required documents

The seller must provide:

  • Pickup voucher / registration confirmation
  • Identity document (front/back)
  • Any document specific to the organization

RunSwap automatically watermarks all documents to prevent any abusive use.

8. Delays, disputes and prohibited behaviors

8.1 Delays

In case of delay in sending documents, RunSwap may:

  • cancel the transaction
  • refund the buyer
  • ban the seller

8.2 Disputes

RunSwap acts as a mediator but:

  • cannot impose a decision on an organizer
  • cannot intervene physically during pickup
  • cannot be responsible for a conflict between users

8.3 Harassment, insults, threats

Any such behavior results in:

  • immediate ban
  • transmission to competent authorities (complaint)

10. Personal data & GDPR

RunSwap collects only necessary data:

  • account management
  • transaction security
  • assistance
  • fraud prevention

Only essential data may be transmitted:

  • to the buyer (pickup documents)
  • to the organizer (in case of danger, fraud, or legal request)

No data is resold, transferred, or commercially exploited.

11. Liability & special cases

RunSwap cannot be held responsible in case of:

  • pickup refusal by the organizer
  • race cancellation or modification
  • fraud or identity falsification by a user
  • use of the bib by a third party
  • wild resale on another channel
  • unilateral decision by the organizer
  • injury, accident, death, or incident during the race

12. Security & anti-fraud

RunSwap stores documents and verifies:

  • name/event consistency
  • identity document consistency
  • double use of the same bib
  • suspicious behaviors

In case of strong suspicion, RunSwap may:

  • block the transaction
  • refuse payment
  • ban the user
  • transmit information to authorities

13. Right of withdrawal

Bib resale is considered as:

  • a digital service executed immediately
  • involving personal and non-withdrawable documents
  • therefore not subject to the right of withdrawal

Any refund request after receipt of documents is inadmissible, except by special agreement with RunSwap.

14. Account deletion

The user may request deletion of their account:

  • via their personal space
  • by simple email

However, certain data must be retained for up to 5 years (legal obligation & anti-fraud).

15. Applicable law & jurisdiction

These ToU are subject to French law.

Any dispute will be brought before the competent courts of Paris.
